Notice of Intent to Award Sole Source Motorola Army CONUS Enterprise (ACE) Land Mobile Network (LMR) System Upgrade Agreement (SUA) The Army Contracting Command- Aberdeen Proving Ground (ACC-APG), Huachuca Division intends to award a sole-source contract to Motorola Solutions, Inc. This action is conducted under the statutory authority permitting other than full and open competition is?10 U.S.C. 3204(a)(1)?as implemented by?Revolutionary Federal Acquisition Regulation Overhaul (RFO) Federal Acquisition Regulation (FAR) 6.103-1(b), Only one responsible source and no other supplies or services will satisfy agency requirements. Furthermore, in accordance with?RFO FAR 6.103-1(d), this document justifies the use of a brand-name description for the required network software upgrades. Intended Awardee: Motorola Solutions, INC 809 Pinnacle Dr STE G, Linthicum Heights, MD 21090 Requirement Description: Army CONUS Enterprise (ACE) Land Mobile Radio (LMR) system is a two-year system built by its vendors. The ACE LMR Motorola system is on a 7th SC(T) contract to implement a technical refresh in order to maintain cybersecurity compliance. Additionally, this tech refresh enabled all installation connected to the ACE LMR Motorola network to fully mission capable on the 2025 HS system version and all property transactions for new equipment accountability are completed and legacy equipment are properly disposed. Failure to keep LMR system up and operational and cyber compliance is a life, health and safety risk. Since 7th SC(T) contract covers the Motorola ACE LMR Technical Refresh for Fort Drum and JBLM Core as well as MOTCO, MOTSU and BGAD, and PD BECS Post Modernization Sustainment Warranty covers Fort Campbell, Fort Hood, Fort Huachuca, Fort Lee, Fort McCoy, West Point, JBLM-Yakima. However, Fort Buchanan, Fort Carson, Tooele, Fort Bragg, Fort Stewart, Fort Rucker, and Holston AAP are without an active contract to cover the Motorola System Upgrade Agreement (SUA). The Motorola Tech Refresh is required for all ACE LMR sites running on Motorola system to avoid any incompatibility issues, and thus, these Motorola ACE LMR sites cannot be left behind without SUA. The contract will consist of a one-year base period. The North American Industry Classification System (NAICS) code is 517810 (All Other Telecommunications), and the business size standard is $40 million. This Notice of Intent to award a Sole Source Contract is not a request for competitive proposals. Motorola Solutions, Inc. is the only company with the System Upgrade Agreement that can service multiple locations for the Army CONUS Enterprise (ACE) Land Mobile Radio (LMR). No other source has proprietary rights, or certified expertise to perform the required services without creating unacceptable risk. Any response to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government. All information received from this notice shall be used for planning and market research purposes only. The determination to refrain from competing for this proposed contract based on responses to this notice is solely within the discretion of the Government. The Government will not pay for the preparation of any information submitted or for the use of such information. Acknowledgement of receipt of responses will not be made, nor will respondents be notified of the evaluation of the information received.
